Terms of Service

1. The Service

Tapemoon is an AI-powered web application for turning songs into music videos. You upload an audio track (for example WAV or MP3) or paste a share link to a song you made. The Service analyzes its tempo (BPM), beats, song sections and lyric timing, plans a storyboard, and renders a beat-synced music video in the format you choose (for example 16:9 or 9:16). We may add further tools, such as lyric videos, audio-reactive visualizers, AI song generation from a prompt or your own lyrics, stem separation (vocals, drums, bass) and cover or promo art. Everything the Service generates for you is together called “Outputs”.

Tapemoon does not sell or license music. You bring the music; the Service creates visuals and related material for it.

The Service is a digital, intangible software-as-a-service product delivered over the internet. Your plan or credits become available in your account as soon as payment is confirmed. No physical goods are shipped.

Tapemoon is an independent product. It is not affiliated with, endorsed by or sponsored by Suno, Udio, YouTube, Spotify, TikTok or any AI model provider named in these Terms.

2. AI models we use

The Service sends your audio, lyrics, prompts and other inputs to the following third-party AI models to create Outputs:

We may change models as providers release new versions; this table is updated when we do. The availability and quality of Outputs depend in part on these providers, and we will communicate significant disruptions in a timely manner.

3. Accounts

You must give accurate information when you create an account and keep your billing email up to date. You are responsible for keeping your login credentials confidential and for all activity under your account. Tell us immediately at support@tapemoon.com if you suspect unauthorized use. If you register on behalf of a company or organization, you confirm you have authority to bind it to these Terms.

4. Plans and credits

The Service offers a free plan and paid subscription plans, billed monthly or yearly. The free plan is a one-time trial, limited to one per person; we may withhold or withdraw it from accounts, devices or networks used to claim it more than once. Paid plans include a monthly allowance of credits, whichever way you pay; credits are spent when you render videos or use other paid generation tools. We may also sell one-time credit packs. Current plan names, prices, billing cycles and included features are shown on our pricing page before you pay.

• Plan credits are granted every month, including on yearly plans, and expire at the end of that month. They do not roll over.
• Credit packs are valid for 3 months from purchase, whether or not you have a subscription.
• When you have both, plan credits are used first.
• If a render fails because of a fault on our side, the credits it used are returned to your balance.
• Credits have no cash value, cannot be transferred or sold, and can only be used on the Service.

We may change plan features or introduce new plans. Price changes for an existing subscription take effect only from your next billing period after we give you at least 14 days’ notice by email; you can cancel before then.

5. Billing and payment

5.1 Recurring billing authorization

When you subscribe to a paid plan, you expressly authorize us (and Waffo Pancake) to charge your payment method the plan price shown at checkout, plus any applicable tax, at the start of each billing period. Subscriptions renew automatically at the end of each billing period until you cancel as described in Section 6. The amount, billing frequency and next renewal date are shown at checkout and in your account. For yearly plans, we email you a reminder about 7 days before each yearly renewal.

5.2 One-time purchases

Each credit pack is a single charge for the amount shown at checkout. We do not top up credits automatically.

5.3 Payment provider

Purchases are sold and processed by Waffo Pancake, our reseller and Merchant of Record, which also handles sales tax and receipts. Its name appears on your receipt and bank statement, and its checkout terms also apply to the purchase.

Your card details go to Waffo Pancake, a PCI-DSS certified processor; we never see or store them. We do not charge any fee for using a particular payment method.

5.4 Taxes

Prices are in US dollars and shown before tax unless stated otherwise. Where sales tax, VAT or GST applies, Waffo Pancake calculates and collects it and shows it before you pay.

5.5 Failed payments

If a renewal payment fails, Waffo Pancake may retry it. If it still cannot be collected, your account moves to the free plan until payment succeeds.

6. Cancellation

You can cancel a subscription at any time:

• Online (recommended): Studio → Billing → Cancel subscription.
• By email: write to support@tapemoon.com from your account email.

Cancel at least 3 business days before your renewal date to be sure the next charge is stopped. After you cancel, you will receive a confirmation email, you will not be charged again, and your paid plan stays active until the end of the period you already paid for, after which your account moves to the free plan. Credit packs you bought separately are not affected and stay usable for their validity period.

7. Refunds

Refunds are governed by our Refund Policy, which forms part of these Terms. In summary:

• You can request a refund within 14 days of any subscription payment (first payment or renewal) or credit pack purchase.
• Duplicate or mistaken charges: always refunded in full.
• Any refund or withdrawal right you have under the law of your country is not affected.

If you think a charge is wrong, please contact us at support@tapemoon.com before disputing it with your bank. We reply within 2 business days and correct confirmed billing errors within 5 business days.

8. Your content and Outputs

8.1 Your inputs

You keep all rights in the audio, lyrics, prompts, images and other material you submit, including songs you link to (“Inputs”). You grant us a limited, non-exclusive license to host, process and transmit your Inputs, including to the AI model providers listed in Section 2, only to operate and improve the reliability of the Service for you. We do not use your Inputs or Outputs to train AI models.

8.2 Rights to the music you upload

You may only upload or link audio and lyrics that you own or have all the rights and permissions needed to use in this way, including the right to create and publish videos set to them. If you made a song with another service (such as Suno or Udio), it is your responsibility to check that your plan or license with that service allows this use. You must not upload or link commercially released recordings, covers or lyrics owned by others unless you hold those rights.

8.3 Outputs

As between you and us, you own the Outputs generated for you, subject to these Terms and to the license that comes with your plan as described on the pricing page (for example, free-plan renders carry a watermark). Because AI models can produce similar results for similar prompts, Outputs may not be unique, and other users may receive similar Outputs.

Outputs do not include any rights to third-party music, lyrics or recordings contained in or synced to them. Owning a video Output does not give you the right to use a song you do not already have the rights to.

8.4 AI-generated content

Outputs are generated by AI and may be inaccurate, inconsistent or unsuitable. Review them before you publish. When you publish Outputs, you are responsible for complying with the rules of the platform you publish on, including any requirement to label content as AI-generated, and you must not present Outputs as footage of real events or real people.

8.5 Copyright complaints

If you believe content on the Service infringes your copyright, email support@tapemoon.com with the subject “Copyright notice” and include: your name and contact details; the work you claim is infringed; a link to or description of the content on the Service; a statement that you have a good-faith belief the use is not authorized by the owner, its agent or the law; a statement that the information in your notice is accurate and that you are the owner or authorized to act for the owner; and your physical or electronic signature. We review valid notices, remove or disable access to infringing content, and tell the affected user. If you believe your content was removed by mistake, you can reply with a counter-notice explaining why. We terminate the accounts of repeat infringers.

9. Acceptable use

You must follow our Acceptable Use Policy. In particular, you must not use the Service to create sexual content, any content that sexualizes minors, graphic gore, hate speech, deepfakes or impersonations of real people, or content that infringes someone else’s copyright or trademark. You also must not:

• swap faces or put any real person, including yourself, into a video;
• use any real person’s likeness without their consent;
• clone a voice, or imitate a specific singer’s or artist’s voice or style so that an Output is presented as theirs, including prompts such as “in the voice of [artist]”;
• attempt to bypass our content moderation, rate limits or security measures;
• use the Service or its Outputs to train, fine-tune or benchmark a competing AI model, or scrape Outputs at scale;
• resell or sublicense access to the Service without our written permission;
• use the Service for anything unlawful, fraudulent or in breach of payment network rules.

10. Our intellectual property

The Service, including its software, design, visual style templates and brand, belongs to us or our licensors. These Terms do not give you any right to use our name or brand.

11. Suspension and termination

You can stop using the Service and delete your account at any time by writing to support@tapemoon.com. We may suspend or terminate your account, remove content and withhold credits if you materially breach these Terms or the Acceptable Use Policy, if we reasonably suspect fraud or abuse, or if the law requires it. Where possible we will tell you why and how to appeal. Accounts terminated for a breach are not entitled to a refund. If we close your account for any other reason, we will refund the unused part of any prepaid period and any unused credit packs.

12. Disclaimers

THE SERVICE AND OUTPUTS ARE PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT AND ACCURACY OF AI OUTPUTS. We do not promise that the Service will be uninterrupted or error-free, or that any video you create will gain views, streams or earn money.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE OR DATA. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. Nothing in these Terms limits liability that cannot be limited by law, or your statutory rights as a consumer.

14. Indemnity

You agree to indemnify us against third-party claims arising from your Inputs, from Outputs you publish, or from your breach of these Terms or the Acceptable Use Policy.

15. Governing law and disputes

These Terms are governed by the laws of Victoria, Australia, without regard to conflict-of-law rules. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live. Before starting any formal proceedings, please contact us at support@tapemoon.com so we can try to resolve the issue informally.

16. Changes to these Terms

We may update these Terms. For material changes we will email you at least 14 days before they take effect and update the date at the top of this page. If you continue to use the Service after the effective date, the updated Terms apply; if you do not agree, you can cancel before then.
